These Terms of Service ("Terms") are an agreement between you and Inkference. They cover the Inkference website at https://inkference.com, the Inkference apps for iPhone and other devices, the Inkference API and AI connector, and everything else we offer (together, the "Service").
Inkference is operated by a sole proprietor based in Ontario, Canada ("Inkference", "we", "us"). You can reach us at inkference@gmail.com.
Our Privacy Policy and Community Guidelines are part of these Terms. Please read all three. By creating an account or using the Service, you agree to them. If you don't agree, don't use the Service.
1. Who can use Inkference
- You must be at least 13 years old. If you are under the age of majority where you live (18 or 19 in most of Canada), you may only use Inkference with the permission of a parent or guardian, who also agrees to these Terms for you.
- You can't use Inkference if we have banned you before, or if the law where you live doesn't allow you to.
- If you use Inkference for a school, club, company or other group, you confirm you may accept these Terms for it.
2. Your account
- Sign up with your email and a password, or with Google, GitHub or Apple. Give a real name or a name you are known by, and an email you can open. We send a link to check your email.
- Your username is public. Don't pick one that pretends to be someone else or uses someone else's brand.
- One person per account. Don't sell, share or transfer your account.
- Keep your password safe. You are responsible for what happens on your account. Tell us right away at inkference@gmail.com if you think someone else got in.
- You can see and sign out your devices in Settings.
3. Your content
"Your content" means anything you post, upload or create on Inkference: posts, projects, photos and galleries, videos, stories, comments, messages, Drive files, Library binders, booth pages, communities, enterprises, songs and playlists, tools, rooms, custom emoji and anything else.
- You own your content. These Terms don't take ownership of it.
- The license you give us. So we can run the Service, you give Inkference a worldwide, non-exclusive, royalty-free license to host, store, copy, process, resize, convert (for example, make video or image versions), display and send your content. We use it only to run, show, secure and improve the Service, and only to the people your settings allow. For content you make public, this includes showing it to people who are signed out, in link previews and share images, and in search engines.
- When the license ends. It ends when you delete the content or your account, except: copies other people saved or that you shared with them (for example messages you sent or files you gave to a project), copies in our backups for a short time, and anything we must keep for legal reasons.
- Your responsibility. You must have the rights to everything you post, including music, photos, notes and other people's work. Don't post anything that breaks the law, these Terms or the Community Guidelines.
- Feedback. If you send us ideas or feedback, we may use them without owing you anything.
4. Who sees what
You choose who sees your posts, projects and galleries: everyone, your followers, your friends, people you pick, or only you. You can also hide your content from specific people, block people, choose who can message you, and choose who sees what you're listening to or working on. Your profile page, username, name and picture are public.
Some things are shared by link. Anyone with a link to a public Library binder, a shared Drive file or a Transfer can open it while the link works. Uploaded files are stored at addresses that are hard to guess, but anyone who has the address can open the file. Don't upload anything you need to keep secret.
5. Rules
Follow our Community Guidelines. In short, you must not:
- post anything sexual involving minors, or any sexual content or nudity,
- harass, bully, threaten, dox or hate on anyone, or encourage violence or self-harm,
- post illegal content, or sell or promote illegal or dangerous goods and services,
- spam, scam, phish, or pretend to be someone else,
- post work you don't have the rights to, or share leaked tests or answers,
- break or get around our security, rate limits, storage limits or bans,
- scrape the Service, collect other people's data, or use bots, except through our Developer API within its limits,
- copy, sell or rebuild the Service, or reverse engineer it, except where the law allows,
- use Inkference to send viruses or harmful code, or to attack other systems.
We have zero tolerance for objectionable content and abusive users.
6. Reporting, blocking and moderation
- You can report any post, project, photo, story, comment, profile, booth, binder, community, enterprise, song, playlist, tool and more. You can block anyone. Blocked people can't see your content or contact you.
- Our team and community moderators review reports. We aim to act on reports of objectionable content within 24 hours.
- We may remove or hide content, limit features, suspend or permanently ban accounts, and tell the police when someone may be in danger or the law requires it. We do this when we believe content or behavior breaks these Terms, the Guidelines or the law, or puts people or the Service at risk.
- Where it's safe and practical, we tell you why. A suspension screen shows the reason and when it ends. If you think we got it wrong, email inkference@gmail.com and we will take another look.
7. Copyright complaints
If you believe something on Inkference infringes your copyright, email inkference@gmail.com with: your name and contact details, the work you own, the link to the content, a statement that you believe in good faith the use isn't allowed, and a statement that your notice is accurate and that you own the rights or may act for the owner. We may remove the content and pass your notice to the person who posted it. We follow Canada's notice and notice rules where they apply, and we close the accounts of people who infringe again and again.
8. Paid plans
- What you get. Plans add storage, more desks, booths and other limits, as shown on the Plans page before you buy. Prices are shown before you pay, in Canadian dollars unless we say otherwise, and may include or add taxes.
- Plans renew automatically. A plan is a subscription. It renews at the end of each month or year, at the price shown to you, until you cancel. We charge your saved payment method on each renewal.
- Canceling. You can cancel any time. On the website, cancel on the Plans page or in Settings. You keep your plan until the end of the period you paid for, then you're back on the free plan. Nothing is deleted when you go back to Free, but new uploads pause if you're over the free storage.
- Switching. When you switch plans on the website, you pay or get back the difference for the rest of the period right away.
- Price changes. We may change prices. We tell you before a new price applies to your next renewal, and you can cancel before then.
- Failed payments. If a renewal payment fails, we may pause or end the paid features until it's paid.
- Refunds. Payments aren't refundable, and we don't refund partial periods, except where the law requires it or we decide to in a particular case.
- Payments on the website are handled by Stripe. Your card details go straight to Stripe and never reach us.
Plans bought in the iPhone app
Plans bought in the iPhone app are sold by Apple through In-App Purchase and charged to your Apple ID. They renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel them in your Apple ID's subscription settings. Apple handles all refunds for App Store purchases. Apple's terms also apply to those purchases.
9. Buying and selling between people
- Coffees (tips), binder sales and emoji. You can support other people with a "coffee", buy paid Library binders and buy custom emoji. Card payments go through Stripe. People who receive money connect a payout account with Stripe and agree to Stripe's terms. Inkference keeps a platform fee (for example 5% of a coffee), shown before you pay. Some ways to tip (like e-Transfer or PayPal) are paid outside Inkference, straight to the person.
- Booths. Booths are small business pages run by our users. Orders, prices, payment and delivery are between the buyer and the booth owner. Inkference isn't a party to those sales and doesn't guarantee them.
- Sellers are responsible for what they sell, for following the law and for their own taxes.
- Flux. Flux and other in-app points are earned by using Inkference. They have no cash value, can't be sold, traded or cashed out, and may change or end.
10. Other services
Inkference works with other services, such as Google, GitHub and Apple for signing in, Spotify for showing what you listen to, Stripe and Apple for payments, and Anthropic's Claude for the desk Assistant and the AI connector. When you use them, their own terms and privacy policies apply too. We aren't responsible for them.
AI features
- The desk Assistant uses your own Anthropic API key. Your questions and the parts of your desk the Assistant reads are sent to Anthropic under your Anthropic account. You pay Anthropic for that use and follow Anthropic's terms.
- The AI connector lets an AI tool you connect read your desk and, if you allow it, make changes. You choose what it may do, and you can turn it off any time.
- AI answers can be wrong. Check anything important.
Developer API
API keys are for you only. Keep them secret. Follow the limits in our developer docs. We may revoke keys that are misused.
11. Our Service
- We give you a personal, limited, non-exclusive, revocable right to use the Service under these Terms. Inkference, its name, logo and design belong to us.
- We change the Service often. We may add, change or remove features, set or change limits (for example storage), and stop parts of it. Some features are early and may change or break.
- We try to keep Inkference running and your data safe, but we can't promise it will always be available or free of errors.
12. Ending your account
- You can delete your account any time in Settings > User > Delete account, on the website or in the app. This deletes your account and your content for good, right away. Files you made in other people's projects stay with that project. Any plan you bought on the website ends. Cancel App Store plans in your Apple ID settings.
- We may suspend or end your account if you break these Terms, if the law requires it, or if your account puts other people or the Service at risk.
- Sections that by their nature should last after your account ends (like your content license for backups, payments owed, disclaimers, limits of liability and governing law) keep applying.
13. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties, express or implied, including that the Service will meet your needs, be secure, or be free of errors, and including warranties of merchantability, fitness for a particular purpose and non-infringement. Content posted by other people is theirs, not ours, and we don't check all of it. Some places don't allow these exclusions, so some of them may not apply to you.
14. Limits on our liability
To the fullest extent the law allows, Inkference isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, from your use of the Service. Our total liability for any claim about the Service is limited to the greater of what you paid us in the 12 months before the claim and 100 Canadian dollars. Nothing in these Terms limits liability that can't be limited by law, including your rights as a consumer.
15. Indemnity
To the extent the law allows, you agree to cover Inkference's losses and costs (including reasonable legal fees) from claims by others about your content, your use of the Service, or your breaking these Terms or the law.
16. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If there's a problem, please email inkference@gmail.com first so we can try to fix it. Any court case must be brought in the courts of Ontario, Canada, unless the consumer protection laws where you live give you the right to go to court there.
17. Changes to these Terms
We may update these Terms. When we do, we post the new version here with a new date and version number, and we keep a record of past versions. If a change is important, we tell you in the app or by email before it takes effect and may ask you to accept the new Terms before you continue. If you keep using the Service after a change takes effect, you accept it. If you don't agree, stop using the Service and delete your account.
18. Apple App Store
If you got the Inkference app from Apple's App Store:
- These Terms are between you and Inkference, not Apple. Inkference, not Apple, is responsible for the app and its content.
- You may use the app on Apple devices you own or control, as allowed by the App Store's Usage Rules.
- Apple has no duty to provide maintenance or support for the app.
- If the app doesn't meet a warranty that applies, you may tell Apple, and Apple may refund the app's purchase price, if any. Apple has no other warranty duty for the app.
- Inkference, not Apple, handles any claims about the app, including product liability, failing to meet a legal or regulatory requirement, and consumer protection claims.
- If someone claims the app infringes their intellectual property, Inkference, not Apple, is responsible for dealing with it.
- You confirm you aren't in a country under a U.S. Government embargo or listed as a "terrorist supporting" country, and you aren't on a U.S. Government list of prohibited or restricted parties.
- You must follow the terms of any other service you use with the app (for example, your mobile carrier).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
19. General
- These Terms, the Privacy Policy and the Community Guidelines are the whole agreement between you and us about the Service.
- If part of these Terms can't be enforced, the rest still applies.
- If we don't enforce a part of these Terms right away, we can still enforce it later.
- You can't transfer your rights under these Terms. We may transfer ours, for example if Inkference is sold or reorganized.
- These Terms are written in English. If we show a translation, the English version applies if they differ.
